PRIVACY NOTICE STATEMENT

This Privacy Policy is hereby adopted in compliance with Republic Act No. 10173 or the Data Privacy Act of 2012 (DPA),  its Implementing Rules and Regulations, and other relevant policies, including issuances of the National Privacy  Commission.

Abacast Shipping and Management Company, Inc. respects your right to privacy and the confidentiality of your information. This Privacy Policy statement is to inform you of the use of your personal information when collected for overseas deployment.

This Privacy Policy provides an approximation on the collection, use, sharing, disclosure, retention, and disposal of Personal and Sensitive Personal Information as defined under the Law.  We shall ensure compliance with the strictest standards of security and confidentiality with respect to all personal or sensitive personal information submitted by our data subjects

What information do we collect, acquire, or gather and why:

As part of our services to you, we collect and gather data through our email and actual interview. Data gathered include, but are not limited to written personal and directory records including photographic images.

We collect and gather data in many ways, including but not limited to our, e-mail and actual interview. The data we gather include, but are not limited to, written personal and directory records, photographic images, and digital material. Concessionaires’ personal data may include information about the concessionaire including their application records such as, but not limited to, Abacast Shipping and Management Company, Inc.  and other documents as required by the company and other governing government agencies.

Who uses your information:

Your information is accessed and used by the Operations Manager, Documentation Officer,  Admin and Accounting Personnel and other staff duly-authorized to process their deployment including their remittances. All users concerned have a legitimate interest in the proper use of data for carrying out their duties.

TO WHOM DO WE DISCLOSE YOUR PERSONAL INFORMATION?

Subject to the provisions of the Data Privacy Act of 2012 and with your consent, we may share and disclose your Personal Information to the following:

  • Third party suppliers and service providers that we engaged to, to help us improve our services to the extent provided in their contract such as but not limited to accredited training centers and medical clinics.
  • Government authorities and such entities that may have legitimate and legal interest in the information, in response to a legal request such as a search warrant, court order or subpoena, if we believe in good faith that we are required to do so under the law.
  • The vessel/s owner whom we referred to as the PRINCIPAL.

Your Personal Information will be shared for the following purposes:

  • To evaluate the necessary documents as required by the Principal in accordance with the IMO, STCW and Port requirements ;
  • To provide remittances on the provided allotee;
  • To communicate and to respond to on-board concerns;
  • To carry out data collection and analysis for the continuous improvement of the company’s;
  • To conduct company audits or investigate a complaint or security threat;
  • To carry out digitization and storage processes;
  • Abacast staff who may require it to perform official duties;
  • Third parties that support the services we provide;
  • Anyone you give us permission to share it with;
  • Official organizations concerned with the detection and prevention of criminal activities;
  • To respond to law enforcement authority or other government regulatory bodies’ requests;
  • To comply with government and other regulatory requirements; and
  • To facilitate the establishment, exercise, or defense of legal claims.

What is the right as subject data?

As a data subject whose Personal Information has been and will be collected and processed by us, you are entitled to the following rights, pursuant to Section 16 of the DPA, and Section 34 of its Implementing Rules and Regulations:

  3. Right to Access
  4. Right to Rectification
  5. Right to Erasure or Blocking
  6. Right to Damages

No Personal Information shall be collected without your consent. If you wish to withdraw consent to the collection of your Personal Information, kindly give us reasonable notice to allow time to cease any and all processing.

In the event that you refuse to give consent, your Personal Information shall no longer be processed, unless:

  • The Personal Information is needed pursuant to a subpoena;
  • The collection and processing are for obvious purposes, including, when it is necessary for the performance of or in relation to a contract or service to which the customer is a party; or
  • The information is being collected and processed as a result of a legal obligation.

Any information to be provided by you shall always be in clear and plain language, to ensure that the information is easy to understand and access.

How we use the applicant’s information:

As we collect information through email and actual interview, its primary purpose is to check seafarer’s documentation regarding its validity and authenticity. We collect and use personal information (including name, address, telephone number, and e-mail) to better provide us with updated data as to access for the processing of their deployment and remittances.

We would therefore use your personal information in order to:

  • for the processing of their application till deployment to disembarkation;
  • for checking and verifying of their legitimate beneficiaries for remittances;
  • for submission to POEA, MARINA, OWWA and other regulatory agencies related to maritime industry;
  • for submission to the Prinicipal/s ( Ship Owners) for their evaluation and approval;
  • compile data and generating reports for statistical and analytical purposes;

In order to improve our services to the Principal, we may wish to use the personal data for their references prior to hiring. As we respect your privacy, we will only use your personal data for this purpose when you are aware thereof and if required, we will request your consent prior to using your personal data for any other transaction aside from this.

How we share seafarer’s information with non-affiliated third parties:

 We don’t share your information with non-affiliated third parties other than as permitted or required by law. We will not disclose any personally identifiable information without your permission unless we are legally entitled or required to do so (for example, if required to do so by legal process or for the purposes of prevention of fraud or other crime) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users or other individuals.

As a manning agency, we do share our disclose information to others include the following:

  • sharing information to the governing regulatory bodies as the case permitted;
  • Arrangement and processing of your allotment to the accredited bank;
  • publishing testimonials, achievements, and success stories in our Facebook page, website, other social media sites, and publications, with your awareness and consent

Please be assured that we will not use your information for any of the purposes if you have indicated that you do not wish us to use your information in this way when submitting the information or at a later stage.

Our practices regarding information confidentiality and security:

We maintain your records through our Quality Management System Procedure for Documented Information. Records such as physical and electronic are kept and safeguarded. These safeguards include but are not limited to the following:

• We restrict access to personal information on the seafarer’s documents to those employees who need to know that information other than those in need of their data as required by law and or their functions;

 • We will punish any employees who impermissibly share your information a written on our Non-Disclosure Policy.

 • We use a system enable password as to secure our internet and e-mail to protect the confidentiality of electronic communications.

Disclosure

Your personal or sensitive personal information shall be retained only for such period as necessary to serve the purpose for which it was collected, or as required under any contract or by any law, rule, or regulation.  Thereafter, it shall be disposed in a secure manner that would prevent further processing, unauthorized access, or disclosure to any other party.

Security of Personal Information

We store your data/information on paper and electronic formats. We take measures to prevent unauthorized access, use, disclosure, disruption, modification, inspection, recording, or destruction of personal information. We ensure Data Privacy thru the implementation of administrative, logical, and physical security controls, for which compliance is monitored by the Data Protection Officer (DPO).

We employ physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access to your information. We choose these safeguards based on the sensitivity of the information that we collect, process and store and the current state of technology. Although we take measures to safeguard against unauthorized disclosures of information, the Internet is not 100% secure so we cannot assure you that  information we collect or store will be protected from all unauthorized access used in a manner that is inconsistent with this Privacy Notice.

PERSONAL DATA RETENTION AND SCHEDULE

 We keep your data only for as long as necessary:

1. For the fulfillment of the declared, specified, and legitimate purposes provided above, or when the processing relevant to the purpose has been completed or terminated.

2. For the establishment, exercise or defense of legal claims

3. For other business purposes that are consistent with standards established or approved by regulatory agencies governing Abacast Shipping.

Thereafter, your personal data shall be disposed or discarded in a secure manner that would prevent further processing, unauthorized access, or disclosure to any other party or the public.

If you wish to withdraw your consent given for any or all purposes set out in this Policy, you may send your detailed request to dccalilung@abacast.com.ph Depending on the nature of your consent withdrawal, Abacast Shipping & Management Co., Inc. may not be in a position to provide you with any employment opportunities.

Privacy Policy Changes /Updates

We reserve the right to amend, modify, or change our Privacy Policy from time to time to comply with the latest issuances or directives from laws and regulations.  We encourage you therefore, to review our Privacy Policy regularly to check for the latest update/s which will be posted on our office and website.

Although most changes are likely to be minor, Abacast Shipping and Management Company, Inc.  reserves the right, acting reasonably, to modify our Policy at any time in our sole discretion, and will publish notice of any such modification on our Facebook page and website. Any modification is effective immediately upon posting.
